Terms of Use

These terms and conditions of use (“Terms of Use”) is for Haarohakki/Haarohakki.com (“Platform”) which operates as a drop shipper, coordinating product handling and shipping services that connects customers with high-quality food and non-food products, facilitating a seamless shopping experience. The Terms of Use are between Haarohakki (“we”, “us”, “our”) and the registered User of the Platform (“You”, “User”, “Your”).

Under this Term of Use, Haarohakki describes the terms on which We offer You access to the Platform You agree to the Terms of Use by using our services (defined herein below). Please take the time to read them thoroughly.  Accessing, browsing or otherwise using the Website indicates Your agreement to all the terms and conditions under this Terms of Use and Your agreement to be legally bound by them. By implicitly or expressly accepting these Terms of Use, You also accept and agree to be bound by all Haarohakki’s Policies, including but not limited to the Privacy Policy available on Platform, as amended from time to time. Both the Terms of Use and Privacy Policy shall be read as one.

If You disagree with any part of these Terms of Use, You must not use the Platform or Services. You accept these Terms of Use by continuing to use the site and the Services, which we may change from time to time. Please review Haarohakki’s Terms of Use periodically for any updates or changes.

These policies are published in accordance with the provisions of the applicable laws and are an ‘electronic record’ as contemplated under the applicable laws. These terms being an electronic record are generated by a computer system and do not require any physical or digital signatures.

  1. USER ACCOUNT, PASSWORD AND SECURITY:

You are completely responsible for keeping Your Display Name and Password secure, as well as all activities that occur under Your Display Name, when You use the Platform. You acknowledge that we have the right to suspend, terminate, or ban Your access to the Platform indefinitely if You provide any information that is untrue, inaccurate, out of date, or incomplete.

You agree to:

  • Report any unauthorized use or breach of Your password or account to Haarohakki at once.
  • Make sure You log out of Your account when You conclude Your session.

We may collect user data including name, email-id, contact details, biometric information etc. to facilitate the Service by creating a unique account of the User or by identifying the User by any means as deemed fit by us. The collection, verification, audit and maintenance of correct and updated User information is a continuous process, and we reserve the right, at any time, to take steps necessary to ensure User’s compliance with all relevant and applicable KYC requirements, if any.

It is assumed that all information provided by the User for accessing and using the Platform and the Service, is correct accurate and up to date. We may verify the information that User has provided and choose to refuse the Service without providing reasons. Also, we reserve the right to terminate the Service on account of misuse and misrepresentation of any information provided by the User.

User account bearing details provided by the User are created and owned by Haarohakki. Any access to the Platform and the Service may be revoked without prior notice in the event of suspicious account activity or malafide intent/conduct of the User. In the case where the system is unable to establish unique identity of the User against the details provided to us, the Service may be denied to the User. We reserve full discretion to suspend a User’s account in the above event and does not have the liability to share any account information whatsoever.

 

  1. SERVICES:

Haarohakki.com allows customers to buy original items from a variety of fashion, lifestyle brands, food and non-food items (collectively, “Products”), through the Platform (our “Services”). The Products can be purchased using a variety of payment methods on the Platform. The purchase of Products will be subject to cancellation policies, exchange policies, return policies, and so on. According to the FDA Guidelines, prior notice to the FDA is not required if the shipper is a family member or friend. We encourage compliance with all applicable regulations when purchasing food products.

As Haarohakki.com has an economic nexus and presence in California, we are obligated to collect sales taxes on qualifying items shipped to the state. The applicable sales tax will be calculated at checkout while the User makes the payment for the order. The Products purchased on the Platform shall be in accordance with the Platform’s Cancellation, Return, and Refund Policy.  It has been specified that Users must verify that the Product being returned is unused and has all of the original tags attached when submitting a return request. If the Products returned by the User are used, damaged, or lacking the original tags, the User’s return request will be denied, and the Product will be re-shipped back to the customer. The User will not be eligible for a refund if the return request is denied, and Haarohakki will not be held liable in this event.

Additionally, if the User refuses to accept delivery of the re-shipped Products, the User will lose his or her right to a refund, and Haarohakki will not be responsible for the re-shipped Product’s return or refund. Furthermore, these Terms of Use may supplement Product-specific terms that are published alongside that Product.

 

  1. USER WARRANTIES AND RESTRICTIONS:

You may only use the Platform for reasonable and authorized purposes, and You agree not to engage in any illegal or harmful behavior to the Platform or its content. You are granted a limited license to access and use the Platform solely for the purpose of receiving the Services, subject to these Terms.

You may not:

  • Sell, resell, barter, or distribute our Products without proper authorization, in accordance with FDA regulations.
  • Delete or edit any content on the Platform that You do not own or have express authorization to modify, including but not limited to information about the Services, their performance, sales or price, legal notices, disclaimers, or proprietary notices such as copyright or trademark symbols, logos;
  • Disassemble, decompile, or reverse engineer the content;
  • Use the Services in any way that is illegal or detrimental to Haarohakki or any other person or entity, as decided solely by Haarohakki;
  • Using any engine, software, tool, agent, or other method to traverse or search the Platform (such as spiders, robots, avatars, worms, time bombs, easter eggs, cancel bots, intelligent agents, and so on);
  • Make false or harmful claims about the Services, the Platform, that is prohibited by Haarohakki;
  • Post, copy, submit, upload, distribute, or otherwise make available any software or other computer files that contain a virus or other harmful component, or otherwise impair or damage the Platform and/or Services or any connected network, or otherwise interfere with any person’s or entity’s use or enjoyment of the Platform and/or Services;
  • Engage in any antisocial, disruptive, or destructive behaviour, such as “flaming”, “spamming”, “flooding”, “trolling”, “phishing”, and “griefing” as those terms are frequently understood and associated with the internet; or
  • Post or upload any content that is libelous, defamatory, abusive, threatening, harassing, hateful, or offensive, or that violates any third-party law or right.

Do not host, display, upload, modify, publish, transmit, update or share on or through the Platform, any information that:

  • Belongs to someone else and to which they have no legal claim;
  • Is blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically unpleasant, insulting, linked to or supporting money laundering or gambling, or otherwise damaging in any way;
  • Harms minors in any way;
  • Infringes on any patent, trademark, copyright, or other kind of intellectual property;
  • Violates any law for the time being in force;
  • Deceives or misleads addressee regarding the origin of such messages, or conveys any material that is grossly insulting or frightening.;
  • Impersonates or defames any other person; or
  • Contains software viruses or other computer code, files, or programmes that are designed to disrupt, destroy, or limit the functionality of any computer resource.

You will not be involved in the transmission of sensitive and personal information while accessing or using the Platform, including but not limited to account information as defined under the applicable laws.

You represent and warrant to Haarohakki.com that You are at least 18 years old, that Your use of the Platform and/or Services will not violate any relevant law or regulation, and that all information provided to Haarohakki in connection with the Platform and/or Services is truthful and correct. If You are below the age of eighteen (18) years, You may avail the Products provided by Haarohakki through Your legal guardian in accordance with the applicable laws.

 

  1. MANNER OF USE OF PLATFORM:

An order for the purchase of a Product placed by You constitutes an offer. All orders You place on the Platforms are contingent on the Product’s availability, Haarohakki’s acceptance of Your offer, and Your continuous compliance with these Terms. You understand and agree that You are accessing the Platform’s Services at Your own risk and that You will use Your best judgment before engaging in any transactions through the Platform. You may place orders for the Products and at the prices specified on the Platform.

All information on third parties, such as vendors and the Products offered on the Platforms (“Third-Party Information”), is given exclusively for informational purposes. Haarohakki does not endorse Third Party Information and is not liable for any mistakes or representations made by the Third-Party Information. You access the Third-Party Information at Your own risk.

If You are permitted to cancel any non-food Product order placed on the Platform within 12 hours from placing such an order, You must return the Products purchased on the Platform in accordance with the Platform’s Cancellation, Return, and Refund Policy. Please note that food Products cannot be returned. 

 

  1. CONSENT TO USE OF DATA

By using the Platform and/or the Service, you agree to the use of your information in accordance with the Privacy Policy available on the Platform.

 

  1. PAYMENT TERMS

By placing an order on the Platform, You agree to pay the total amount due for the Products and Services selected at the time of checkout. Prices and availability of Products are subject to change without notice, and the final price payable will be the amount displayed at the time of placing the order.

Payment Methods

We accept the following payment methods:

  • Credit Cards: Visa, MasterCard, American Express
  • Debit Cards
  • Net Banking
  • UPI and other online wallets (as made available from time to time)
  • International payments (where supported)

Payment must be made in full before an order is confirmed or processed.

Applicable taxes, including but not limited to Goods and Services Tax (GST) in India or Sales Tax in the United States, and shipping charges will be calculated and added at checkout. You are responsible for paying all such taxes and charges.

Upon successful completion of payment, a digital invoice will be generated and sent to Your registered email address. You may also access Your invoices under Your account dashboard on the Platform.

Refunds, if applicable, will be processed as per our Cancellation, Return, and Refund Policy, subject to eligibility. Any chargeback raised without prior communication or in violation of the stated policy may result in suspension of services or legal action, at Haarohakki’s discretion.

In case of a payment failure due to a technical or transactional error, Haarohakki shall not be held responsible for any consequences resulting from delay or non-processing of the order. You are encouraged to retry the payment or use an alternate method.

All transactions on the Platform will be processed in Indian Rupees (INR) unless otherwise specified or supported for international orders.

 

  1. DISCLAIMER OF WARRANTIES:

Haarohakki strives to make Your access and usage of the Platform seamless and free of errors. However, Haarohakki may pause or restrict Your access from time to time so as to carry out maintenance of the Platform. Do be mindful that Haarohakki is not responsible for any issues that may arise with regards or access or usage due to Internet based problems at Your end. At any time, Haarohakki has the right to restrict access to the Platform, terminate accounts, remove or edit content at its sole discretion.

Haarohakki does not pre-screen the content on its Platform, which contains User-generated and expert-generated perspectives. Haarohakki makes no claim to the text, files, images (including photos, videos, sounds, and musical works), or any other User-generated content that You may submit or post on the Platform. You retain ownership of any rights that they may have in any User generated content You upload on the Platform, subject to the limited license set out below. Haarohakki will make every effort to monitor, alter, or remove any User-generated content that it deems suitable or necessary. Haarohakki makes no representations or warranties as to the accuracy, completeness, or timeliness of any User-generated content on the Platform, or that it will not offend or upset anybody, or that it will not infringe on third-party intellectual property rights.

Haarohakki provides visual representations on the Platforms, such as graphics, illustrations, pictures, images, videos, charts, screenshots, infographics, and other visual aids, to assist You in recognizing the Products of Your choosing. Haarohakki will take efforts to make accurate visual representation, however this is not a guarantee or warranty to the accuracy of the visual representation or descriptions of a Product in comparison to the actual Product received by You. For a variety of reasons, the look of the Product when delivered may differ.

The Services provided by the Haarohakki Platform are provided “as is” and on “as available” basis. They are without any representations or warranties, both express or implied, excluding where it is specified in writing. Haarohakki makes no promises or guarantees whatsoever.

 

  1. INDEMNITY:

You shall indemnify and keep indemnified Haarohakki and its directors, employees, customers, affiliates and agents harmless from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs, including attorney’s fees and court costs, which Haarohakki may incur, pay or become responsible as a facilitator as a result of Your breach or alleged breach of the representations or obligations under the Terms of Use. Haarohakki or their respective affiliates shall not be responsible for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by the member or any third party, in connection with the offer.

 

  1. TERMINATION:

The terms set out here shall be applicable from the date of publication on the platform.

In the event of a breach of any of these Terms, misrepresentation of information, any unlawful action by You, or if Haarohakki is unable to verify or authenticate any information given by You, Haarohakki retains the right to stop or cancel its Services.

You have the right to end the Agreement at any time by ceasing to use the Services or the Platform. You will be required to pay for any purchases made on the Platform, as well as any other unfulfilled obligations that have accumulated prior to termination, if You have terminated the agreement.

 

  1. FORCE MAJEURE:

Haarohakki shall not be liable to You for failure or delay of performance of its obligations, to the extent that such failure or delay is caused by riots, civil commotion, wars, hostilities, pandemic, epidemic, embargoes, actions by governments or any agency thereof, acts of god, storms, fires, accidents, strikes, sabotage, power and infrastructure outages, failure of telecommunications or internet services, cyberattacks, system failures, explosions or other similar or different contingencies beyond the reasonable control of the Party.

 

  1. LIMITATION OF LIABILITY:

In no event shall Haarohakki be liable for any indirect, punitive, incidental, special, consequential damages or any other damages resulting from:

the use or the inability to use the Services or Products;

unauthorized access to or alteration of the User’s transmissions or data;

breach of condition, representations or warranties by the manufacturer of the Product;

any other matter relating to the services including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Platform or Service.

 

  1. INTELLECTUAL PROPERTY RIGHTS

All content included on the Platform, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Haarohakki, its affiliates, associates or its content suppliers and is protected by Indian/ International copyright, authors’ rights and database right laws. The compilation of all content on the Platform  is the exclusive property of Haarohakki, its affiliates, associates or its content suppliers and is protected by laws of Indian/ International copyright and database right laws. All software used on this App is the property of Haarohakki, its affiliates, associates or its software suppliers and is protected by laws of India and international copyright authors rights and database laws.

 

  1. DISCLAIMER

You, being a User of the Platform, expressly agree that the use of the Platform  is at Your sole risk. The Platform e and the contents uploaded or provided or shared by other Users are made available to the User through the Platform  on an “as is” basis and “as available basis” without any warranty of any kind, express, implied, statutory or otherwise, including the implied warranties of title, non-infringement, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability or fitness for a particular purpose or the legality of the Products listed or displayed or transacted to the extent permitted by applicable Indian law and Haarohakki does not accept any liability for any errors or omissions.

Haarohakki shall not be liable or responsible for any actions or inactions of sellers or any breach of conditions, representations or warranties by the sellers or manufacturers of the Products and expressly disclaims any and all responsibility and liability in that regard. Haarohakki shall not mediate or resolve any dispute or disagreement between the User and the sellers or manufacturers of the Products.

 

  1. GOVERNING LAW AND JURISDICTION:

The laws of India shall govern these Terms of Use and all other policies of Haarohakki and the Courts of Bangalore, India shall have the exclusive jurisdiction.

 

  1. WAIVER OF COMPLIANCE:

Except as other provided in these Terms, any failure by You to comply with any obligation, covenant or agreement contained herein may be waived only by a written notice from Haarohakki entitled to the benefits thereof. Consent granted by Haarohakki, or waiver of a breach by a User, whether express or implied, shall not be construed as waiver or excuse for any other different or subsequent breach.

  1. MISCELLANEOUS

Report Abuse: In the event You come across any abuse or violation of these Terms of Use or if You become aware of any objectionable content on the Platform, please report to the (Insert the email)

Privacy Policy: The User hereby consents, expresses and agrees that the User has read and fully understands the Privacy Policy in respect of the Platform. You further consent that the terms and contents of such Privacy Policy are acceptable to You.

Notice: All notices of Haarohakki will be served by email. Any notice provided to Haarohakki pursuant to the Terms of Use should be sent to Haarohakki’s address as notified in the Platform.

Assignment: You cannot assign or otherwise transfer the Terms of Use, or any rights granted hereunder to any third party. Haarohakki’s rights under the Terms of Use are freely transferable by Haarohakki to any third parties without the requirement of seeking Your consent.

Severability: If, for any reason, a court of competent jurisdiction finds any provision of the Term of Use, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Terms of Use shall continue in full force and effect.

You may submit any grievance with respect to the Platform or the Services or any other policies, including with respect to any abuse on the Platform, including any discrepancies or grievances with respect to processing of information, to the Grievance Officer at:
